Terms of Use

Last updated: October 7, 2026

These Terms of Use govern your use of oemearthworks.com (the "Site"), operated by OEM Earthworks, LLC ("OEM Earthworks," "we," "us," or "our"). By accessing or using the Site, you agree to these Terms. If you do not agree, please do not use the Site.

OEM Earthworks provides land management, forestry mulching, land clearing, wildlife and habitat services, excavation, and erosion control. The Site exists to share information about those services and to let you contact us.

1. Use of the Site

You may use the Site for lawful, personal, or business purposes related to learning about or requesting our services. You agree not to:

  • Use the Site in any way that violates applicable law

  • Submit false, misleading, or fraudulent information through any form

  • Attempt to gain unauthorized access to the Site, its servers, or connected systems

  • Introduce viruses, malware, or other harmful code

  • Scrape, copy, or harvest Site content or data by automated means without our written permission

  • Interfere with the Site's operation or other visitors' use of it

We may restrict or end access to the Site for anyone who violates these Terms.

2. Information Only — Not an Offer or Contract

Content on the Site, including service descriptions, photos, and project examples, is for general information only. Nothing on the Site is a quote, bid, guarantee, or binding offer.

Every project depends on site conditions such as soil, terrain, access, drainage, utilities, permits, and weather. Pricing, scope, and timelines are set only in a written estimate or agreement signed by OEM Earthworks. That written agreement, not the Site, governs any work we perform.

Photos and project examples show past work and may not reflect the results achievable on your property.

3. Quote Requests and Communications

When you submit a contact or quote request form, call us, or message us through social media, you agree that the information you provide is accurate and that you are authorized to request work on the property you describe.

By submitting your contact information, you agree that OEM Earthworks may contact you by phone or email about your request. We do not send marketing text messages. If you choose to text us, we will reply by text to continue that conversation, but only about your inquiry or project and only because you started it. Message and data rates may apply. You can ask us to stop contacting you at any time using the details below.

Submitting a form does not create a contract or guarantee that we will accept a project or be available on a specific date.

4. Intellectual Property

The Site and its content, including text, photos, videos, graphics, logos, and the OEM Earthworks name, are owned by or licensed to OEM Earthworks and are protected by copyright and trademark law.

You may view and share links to Site pages. You may not copy, reproduce, modify, or use our content, photos, or branding for commercial purposes without our prior written permission.

5. Third-Party Links, Advertising, and Tracking

The Site may link to third-party websites and platforms, such as Facebook, Instagram, Google, and mapping services. We do not control and are not responsible for their content, policies, or practices. Your use of those sites is governed by their own terms.

We advertise on platforms including Meta (Facebook and Instagram) and Google. The Site uses cookies, the Meta Pixel, and similar analytics and advertising tools to measure Site traffic, understand how visitors use the Site, and show relevant ads. You can manage cookies through your browser settings and adjust ad preferences in your Facebook, Instagram, and Google account settings.

Our Privacy Policy explains what information we collect and how we use it, and is part of these Terms.

6. Disclaimers

The Site is provided "as is" and "as available." We try to keep information accurate and current but make no warranties, express or implied, that the Site is complete, error-free, uninterrupted, or free of harmful components. Information on the Site is not professional engineering, surveying, environmental, or legal advice for your property.

7. Limitation of Liability

To the fullest extent permitted by law, OEM Earthworks and its owners, employees, and contractors are not liable for any indirect, incidental, special, or consequential damages arising from your use of, or inability to use, the Site. This section applies to use of the Site only. Liability for any work we perform is governed by the written agreement for that project.

8. Indemnification

You agree to indemnify and hold harmless OEM Earthworks from any claims, losses, or expenses, including reasonable attorneys' fees, arising from your misuse of the Site or violation of these Terms.

9. Governing Law

These Terms are governed by the laws of the State of Kansas, without regard to its conflict of law rules. Any dispute arising from these Terms or your use of the Site will be brought in the state or federal courts located in Jefferson County, Kansas.

10. Changes to These Terms
